A QDRO (Qualified Domestic Relations Order) is a court order that tells a retirement plan administrator to divide benefits between divorcing spouses. Your divorce decree can say whatever it wants about who gets what—the plan administrator only acts on a properly approved QDRO.

A QDRO should be prepared by someone who knows both divorce settlements and retirement plan rules. Attorneys can draft them, but many refer this work to specialists like us who focus specifically on retirement asset division. We draft the order, coordinate with the plan administrator, and handle submission.
First we gather information—your divorce decree, plan details, and account statements. Then we draft the QDRO using plan-specific language. Most plans offer a pre-approval review before court submission. Once the plan confirms the draft meets their requirements, a judge signs the order. After court approval, we submit the final QDRO to the plan administrator for processing.

A 401(k) is typically divided according to the divorce settlement—either as a percentage or a specific dollar amount. But the plan administrator won't transfer anything without a court-approved QDRO. Once the QDRO is processed, the non-employee spouse can roll their share into their own retirement account or, in some cases, take a direct distribution without the usual early withdrawal penalty.

Pension division depends on the plan and what the QDRO specifies. The non-employee spouse might receive their own separate benefit, or both spouses might share payments when the employee retires. The QDRO also needs to address survivor benefits—what happens if the employee dies before retirement or before the non-employee spouse starts receiving payments.
Typically 1-6 months from start to finish. Simple defined contribution plans with cooperative administrators move faster. Complex pensions or plans with slow review processes take longer. We work to minimize delays, but timeline also depends on how quickly we receive documents and how responsive the plan administrator is.
If a plan administrator rejects a QDRO, we identify the issue, make corrections, and resubmit. Most rejections happen because the language doesn't match plan requirements or required provisions are missing. Our goal is to get orders approved on the first submission, but if corrections are needed, we handle them at no additional charge.
